We welcome you to enjoy our product and site. The following terms and conditions create a legally binding contract between you and Xenopuck LLC.

The Xenopuck (meaning the product we sell and distribute, the training puck) is meant for training alone. Use extreme caution when shooting and maintain a safe distance. Further, you must not shoot with other people in the area. Never shoot at a goalie. We recommend wearing full protective gear. This puck as with all pucks have the potential to ricochet and change direction after contact with another object. Never shoot at a goalie and never play games with the Xenopuck product. Hockey is dangerous and you must use caution when training. Minors are to be supervised by parents or guardians at all times.

Limitation of Liability.

Xenopuck LLC will not be held liable for any damages of any kind resulting from use of the Xenopuck, inability of use, the materials and content on this site or lack thereof, or the actions of the Xenopuck, even if the company of Xenopuck LLC has been advised of the possibility of such damages. Some laws may not allow for the above limitation of liability to apply to you, and if so then the above items do not apply to you.

Indemnification.

By using this site you agree indemnify, defend and hold harmless Xenopuck LLC, and all its’ agents, and other related providers from all damages, costs, expenses and losses occurring from breaching these terms and conditions, which include but are not limited to all negligent and/or unjust acts and other activity that you do on your part.

Permitted Use.

The Xenopuck product’s permitted use is as a training puck only. The product is not intended for shooting and/or passing. Use caution when other people are in your direct vicinity.  

 Intellectual Property Policy.

Any and all property, content, trademarks, patents, designs, and copyrights that pertain to this website or the Xenopuck product are the property of Xenopuck LLC or it’s licensing partners, and are subject to the applicable laws, regulations, and international treaties/agreements relating to intellectual property.

Trademarks and other associative representations of the Xenopuck LLC company and Xenopuck product including but not limited to all product, content, images, text, and videos appearing on this site are the property of Xenopuck LLC or its licensing partners and are subject to all applicable laws, regulations, and other internationally recognized treaties.

Returns.

Xenopuck LLC reserves the right to reject any request for a refund of full or partial purchases. Further, Xenopuck LLC reserves the right to reject any refund of full or partial purchases. Xenopuck LLC will evaluate the request for any requested refund or return or partial or full value of the initial purchase. To request a return please email info@xenopucks.com.

Communication.

Xenopuck LLC reserve the right to contact you by email at the email addresses you have provided to us by using and accessing this site.  Further, Xenopuck LLC reserves the right to contact you using the information that you provided to the website. Xenopuck LLC will not sell your data or disclose any information provided to us via this site or other means.  You may contact Xenopuck LLC if you wish to remove your name from any marketing or advertising directed toward you.  Site Use.

Any sort of provocation or wrongful acts in any matter is prohibited. Xenopuck LLC will not tolerate any abuse in any form. You must not threaten anyone, obtain personal private information, access secure company resources or that of any Xenopuck LLC partners including customers or agents of the company. You may not perform libelous activities or any other criminal and/or negligent activity against Xenopuck LLC or any users of this site. You may not utilize this site in a manner of impersonating the Xenopuck LLC company in any way.

Third Parties.

Xenopuck LLC may at times partner with third parties separate from Xenopuck LLC, further, we may also provide directions and links within our site to other third parties separate from Xenopuck LLC, and Xenopuck LLC does not have control over these sites. Use caution when operating with outside links separate from the Xenopuck LLC website.

Term.

The terms and conditions are in effect while you are using this site and also completing the entire process of registering and shopping throughout the site. These terms and conditions may be terminated and/or canceled at any time by Xenopuck LLC with no notice and for any reason deemed fit by Xenopuck LLC. Certain provisions within this document will survive the termination of these terms and conditions These provisions are listed and defined above, but are listed here as Limitation of Liability.  Further, the negation of any point listed in these entire terms and conditions will not invalidate the other points validity.

The use of this site is to be governed by the state of Florida, of the United States of America. Further, the jurisdiction of our governance is the State of Florida. Any disputes will be resolved under the laws of the State of Florida.

 European Union Policy.

If as your specific laws do not apply these terms and conditions then Xenopuck LLC will work directly with you so that specific laws, regulations, and conventions are properly followed. Xenopuck LLC aims to work in a friendly and fair way with everyone of our partners, customers, and stakeholders.

 Flame Hazard.

Never expose the Xenopuck to Flame or other potential ignitions sources. . Flames resulting from burning may emit toxic smoke and gasses as well as cause serious injuries and property damage.

Corrosion Hazard.

Never Expose the Xenopuck to chemical reactants or other corrosive and reacting substances. Resulting chemical interactions may emit toxic smoke and gasses as well as cause serious injuries and property damage.
